Internal misconduct is a universal problem in prisons and affects the maintenance of social order. Consequently, correctional institutions often develop rehabilitation programs to reduce the likelihood of inmates committing internal offenses and criminal recidivism after release. Therefore, it is necessary to identify the profile of each offender, both for the appropriate indication of a rehabilitation program and the level of internal security to which he must be submitted. In this context, this work aims to discover the most significant characteristics in (...) predicting inmate misconduct from ML methods and the SHAP approach. A database produced in 2004 through the Survey of Inmates in State and Federal Correctional Facilities in the United States of America was used, which provides nationally representative data on prisoners from state and federal facilities. The predictive model based on Random Forest performed the best, thus, we applied the SHAP to it. Overall, the results showed that features related to victimization, type of crime committed, age and age at first arrest, history of association with criminal groups, education, and drug and alcohol use are most relevant in predicting internal misconduct. Thus, it is expected to contribute to the prior classification of an inmate on time, to use programs and practices that aim to improve the lives of offenders, their reintegration into society, and consequently, the reduction of criminal recidivism. BREVES PONDERAÇÕES ACERCA DO INSTITUTO DA DELAÇÃO PREMIADA APÓS A LEI Nº 12.850/2013.

O presente trabalho reflete sobre a significativa e desigual morte de jovens negros no País. Para tanto, a produção traz uma discussão sobre o teórico martinicano Frantz Fanon que, com suas ideias sobre racismo e colonialismo, nos ajuda a reconhecer o racismo brasileiro e a condição em que vivem os jovens negros do Brasil. Apesar de Fanon afirmar que suas considerações se referem apenas ao momento histórico em que escreve e aos estudos de colonialismo, acreditamos ser fácil fazer um paralelo (...) entre sua obra e o momento histórico brasileiro quanto à morte de jovens negros. Analisamos as três formas de violência trazidas pelo teórico: psicológica, estrutural, e física, dentro das quais vivem e morrem tais jovens. Buscamos, ainda, refletir sobre a construção das identidades e juventudes negras para compreender, onde e de que forma, estão inseridas na sociedade brasileira. Para tanto, acreditamos ser necessário analisar de que modo se dá o racismo brasileiro e conhecer o que denominamos de falso mito da igualdade racial, contra o qual lutamos constantemente, em busca de reconhecimento do problema, para que possamos buscar soluções. O trabalho aborda a Lei n. 10.639/2003 que versa sobre a obrigatoriedade de se trabalhar na escola a cultura africana e afro-brasileira. Consideramos a lei uma importante política pública na promoção de igualdade racial, através da valorização da cultura vinda do continente africano. Acreditamos que a implementação efetiva dessa lei apoia a construção de identidades negro-positivas tanto para negros quanto para não negros e que essa valorização das identidades serve como importante ferramenta na luta contra a significativa morte de jovens negros no País. Dans cet article, je propose une exploration du phénomène du témoignage. Mon but est de montrer que la perspective phénoménologique rend possible une approche intégrative du témoignage, compris comme un phénomène qui engage la structure existentielle du sujet, articulant les relations entre langage, présence, mémoire, vérité et temporalité. Le témoin n’est pas seulement celui qui témoigne, mais d’abord celui qui affronte, dans sa présence expérientielle, un événement dont le sens est bouleversant et institue ainsi le sujet comme témoin : soit (...) comme « témoin endurant » si l’enjeu est d’abord le soi le plus propre du témoin, ou comme « témoin oculaire»s’il s’agit principalement de l’autre. Le témoignage trouve sa signification particulière dans la tension qui se creuse entre le pôle ontologique, où le témoin est compris comme « être là » en présence de l’événement sur le plan expérientiel, et le pôle herméneutique, où le témoin est convoqué devant les autres au niveau du langage. Une autre différence doit être tracée entre le « témoin-confessant », lorsque le témoignage porte précisément sur ce que le témoin a enduré soi-même, et le « témoin-tiers », dont le témoignage porte sur ce que l’on a principalement observé sans le subir soi-même. Après l’analyse du problème du corps dans les écrits levinassiens de jeunesse, problème que nous avons exposé dans un précédant numéro de la revue ( Les Études Philosophiques, vol. 113 (2013), n o 2, pp. 201-219), nous nous focalisons dans cet article sur la période moyenne de l’œuvre de Levinas, et notamment sur Totalité et Infini. La corporéité est ici caractérisée constamment par une sorte d’ambivalence, la dimension incarnée du sujet étant souvent placée dans une certaine ambiguïté. Nous essayerons de (...) montrer comment la corporéité, toujours équivoque, fait intimement partie de la relation originaire du sujet avec le monde, avec soi-même et avec l’autre. Pour cela, nous étudierons plusieurs rapports essentiels où intervient le problème de la chair : entre le corps et la conscience, entre le corps et l’élément, entre le corps et l’habitation, entre le corps et le travail, et, finalement, entre le corps et l’autre. Background: The internationalization of clinical studies requires a shared understanding of the fundamental ethical values guiding clinical studies. It is important that these values are not only embraced at the legal level but also adopted by clinicians themselves during clinical studies. Objective: Our goal is to provide an insight on how clinicians in Germany and Poland perceive and identify the different ethical issues regarding informed consent in clinical studies. Methods: To gain an understanding of how clinicians view clinical studies in (...) the countries they work in, we carried out semi-structured problem-centered interviews per telephone in Poland (n = 6) and Germany (n = 6). Our interviewees concentrated on three main topics: an appraisal of the normative framework, challenges in the information process and the protection of all participants in clinical studies. Results: Clinicians generally supported the normative framework, even though they considered it quite complex. In the two study countries, a widely noted dilemma in the information process was whether to overburden participants with extensive information or risking leaving out important facts. Clinicians were ready to exclude larger population groups from participating in clinical studies when the information process could not be carried out with standard procedures or when their inclusion was ethically sensitive. Conclusion: Clinicians need to gain a better understanding of the consequences of excluding larger population groups form participating in clinical studies. They should seek assistance in improving the information process for the inclusion of underrepresented groups in clinical studies. (shrink)

The development of new methods in the field of prenatal testing leads to an expansion of information that needs to be provided to expectant mothers. The aim of this research is to explore opinions and attitudes of gynecologists in Germany, Poland and Russia towards access to prenatal testing and diagnostics in these countries. Semi-structured interviews were conducted with n = 18 gynecologists in Germany, Poland and Russia. The interviews were analyzed using the methods of content analysis and thematic analysis. Visible (...) in all three countries is a connection of prenatal medicine with the politically and socially contentious issue of pregnancy termination. Respondents in Poland and Russia concentrated on the topic of inadequate resources. Quality of information for expectant mothers is an important point in all three countries. Only in Germany was the issue of language barriers in communication raised. With regard to non-invasive prenatal testing (NIPT) respondents in Germany focused on the ethical issues of routinization of testing; in Poland and Russia they concentrated on fair access to NIPT. Challenges in all three countries arise from structural factors such as imprecise and prohibitive regulations, lack of resources or organization of healthcare services. Purpose: The method of diagnosing diabetic retinopathy (DR) through artificial intelligence (AI)-based systems has been commercially available since 2018. This introduces new ethical challenges with regard to obtaining informed consent from patients. The purpose of this work is to develop a checklist of items to be disclosed when diagnosing DR with AI systems in a primary care setting. -/- Methods: Two systematic literature searches were conducted in PubMed and Web of Science databases: a narrow search focusing on DR and a (...) broad search on general issues of AI-based diagnosis. An ethics content analysis was conducted inductively to extract two features of included publications: (1) novel information content for AI-aided diagnosis and (2) the ethical justification for its disclosure. -/- Results: The narrow search yielded n = 537 records of which n = 4 met the inclusion criteria. The information process was scarcely addressed for primary care setting. The broad search yielded n = 60 records of which n = 11 were included. In total, eight novel elements were identified to be included in the information process for ethical reasons, all of which stem from the technical specifics of medical AI. -/- Conclusions: Implications for the general practitioner are two-fold: First, doctors need to be better informed about the ethical implications of novel technologies and must understand them to properly inform patients. Second, patient's overconfidence or fears can be countered by communicating the risks, limitations, and potential benefits of diagnostic AI systems. If patients accept and are aware of the limitations of AI-aided diagnosis, they increase their chances of being diagnosed and treated in time. (shrink)

A formação docente brasileira foi marcada por interlocuções epistêmicas, mudanças e transformações estruturais e conjunturais, atreladas aos âmbitos sociais, culturais, econômicos, jurídicos e políticos, influenciando e configurando as dimensões do ser professor. Sua configuração, como um ser social, permite a transposição dicotômica entre conhecimentos científicos e senso comum, possibilitando reflexões a uma análise conjuntural acerca da realidade posta, efetivando a essencialidade do processo formativo elucidada a partir do rompimento alienado efetivado por meio dos princípios ideológicos que regem, fragilizam e fragmentam (...) essa formação. Propomos analisar evidências delineadas na Resolução CNE n. 6/2018, acerca da implementação nacional de políticas institucionalizadas neoliberais para formação docente em Educação Física. Para tal feito, nos ancoramos em características investigativo-descritivas com pressupostos de análise de conteúdo e documental, sustentados pelo subentendimento da teoria da alienação trazidas por Konder. Diante das análises, destacam-se indicadores dos ideários neoliberais, transcritos por meio de orientações com vistas à formação docente para atuação no mundo do trabalho. A partir das orientações normatizadas em prol de um processo formativo com competências e habilidades, delineadas nos indicadores destinados à “área de estudo e pesquisa”; “área de conhecimento específico para educação”, “atividade acadêmica para prática pedagógica”; e “componente curricular”, evidenciando os pressupostos de uma formação sistêmica e linear, subscrevendo a formação humana do futuro professor a determinados interesses e com viés que diverge dos pressupostos educacionais, suscitando uma possibilidade de alienação, induzindo à formação docente por meio de uma ideologia prescrita subliminarmente, à qual o profissional em formação será submetido, dificultando, por vezes, a construção de um conhecimento que propicie sua emancipação de forma crítica e reflexiva acerca da realidade social. Com este breve artigo, prendemos fazer um estudo sobre os Sodomitas “de cor” perseguidos pela Inquisição Portuguesa na Bahia do século XVII. Inicialmente, faz-se uma reflexão sobre a Sodomia, delito contra a fé católica, crime que estava sob a alçada do Tribunal do Santo Ofício e que fora praticado pelos negros escravizados e a partir dos documentos inquisitoriais, discorremos sobre a trajetória dos desviantes: o cativo lisboeta Jeronimo Soares, que fora acusado de sodomita e “alcoviteiro” e o mulato ator cômico (...) Bugio, denunciado por praticar sodomia, por fim, procuramos evidenciar as andanças, força, formas de repressão utilizadas contra esses sodomitas no contexto baiano, assim com a influência da religião – Igreja Católica – e as ferramentas de controle utilizadas para “convencer” a sociedade colonial a seguir o caminho correto da fé e da moral. As fontes utilizadas são os registros de depoimentos dos “hereges” e das testemunhas, produzidas pelo Santo Ofício, localizadas no Arquivo Nacional da Torre do Tombo : Sumário de culpa nº 12257 e Caderno do Promotor nº 29. Este trabalho é um estudo observacional descritivo retrospectivo, com análise de dados quantitativos de abril a julho de 2019 no Hospital Universitário de Canoas. Foram avaliados 419 prescrições e dados de pacientes quanto a sexo, idade, patologias prévias, vias de administração e medicamentos mais prescritos no CTI. Para análise, foi elaborado um Instrumento de Coleta de Dados, no qual foram transferidos para uma planilha do software Microsoft Excel para análise de frequência. Os resultados encontrados foram que a maioria dos pacientes (...) era do sexo masculino (59%), com idade entre 40 e 69 anos (47%). As patologias mais frequentes foram Hipertensão Arterial (31%), Diabetes Mellitus (18%) e outras como infecções bacterianas, fraturas ou cirurgia cardíaca (46%). A via de administração mais utilizada foi a parenteral (63%). Os medicamentos mais prescritos foram analgésicos / antipiréticos (n = 175), analgésicos narcóticos (n = 126) e antieméticos (n = 126). A caracterização do perfil farmacoterapêutico permitiu definir estratégias de avaliação da prescrição e propor o serviço de farmácia clínica para contribuir com o conhecimento de outros profissionais relacionados aos medicamentos. O objetivo central deste artigo é o de discutir se Husserl de fato consegue apresentar uma compreensão derradeira da intersubjetividade de um modo estritamente transcendental e assim se Husserl pôde ou não superar definitivamente toda forma de solipsismo. A posição que pretendo defender é que Husserl consegue apresentar uma compreensão coerente de intersubjetividade entendida em termos transcendentais a partir de um aprofundamento dos processos de redução transcendental. Será defendido também que a explicitação do estatuto transcendental da intersubjetividade não se contrapõe (...) de maneira alguma ao idealismo transcendental fenomenológico proposto por Husserl, ao contrário, será mostrado que a compreensão do estatuto transcendental da intersubjetividade contribui para uma melhor e mais adequada caracterização do que é o campo do idealismo transcendental fenomenológico em Husserl. Pagando por suas alforrias, batizando seus filhos, enterrando seus mortos. Além do trabalhado pesado ainda havia espaço para afetividade, vida sexual, desejos e vontades das mulheres que viviam no sul da capitania. E não faltavam acusações de sodomias, feitiçarias, seduções, bigamias. Este texto é fruto de um projeto de pesquisa em andamento que perscruta mulheres africanas no sul da Bahia e desdobra-se em duas partes de suas vidas no período colonial e imperial, tomando-as não só como objetos de pesquisa, mas (...) dando-lhes a condição de serem narradas como protagonistas apoiadas em vastas e inéditas fontes. Este artigo optou por trazê-las no período colonial. Quanto ao período aludido sobressaiu-se nas fontes dois aspectos: as pecadoras denunciadas estavam relacionadas ou às práticas de feitiçaria ou à vida sexual e afetiva destoante do que preconizava as leis cristãs, sobretudo nos Cadernos do Promotor. As fontes utilizadas foram os Cadernos do Promotor, as Correspondências trocadas entre autoridades e uma memória descritiva sobre ser mulher, ser africana e ser escravizada ou forra em diferentes discursos. Exclusionary defeat is Joseph Raz’s proposal for understanding the more complex, layered structure of practical reasoning. Exclusionary reasons are widely appealed to in legal theory and consistently arise in many other areas of philosophy. They have also been subject to a variety of challenges. I propose a new account of exclusionary reasons based on their justificatory role, rejecting Raz’s motivational account and especially contrasting exclusion with undercutting defeat. I explain the appeal and coherence of exclusionary reasons by appeal to commonsense (...) value pluralism and the intermediate space of public policies, social roles, and organizations. We often want our choices to have a certain character or instantiate a certain value and in order to do so, that choice can only be based on a restricted set of reasons. Exclusion explains how pro tanto practical reasons can be disqualified from counting towards a choice of a particular kind without being outweighed or undercut. (shrink)

Political legitimacy is best understood as one type of a broader notion, which I call institutional legitimacy. An institution is legitimate in my sense when it has the right to function. The right to function correlates to a duty of non-interference. Understanding legitimacy in this way favorably contrasts with legitimacy understood in the traditional way, as the right to rule correlating to a duty of obedience. It helps unify our discourses of legitimacy across a wider range of practices, especially including (...) the many evaluations we increasingly make of international institutions of various sorts, but also including domestic institutions. Standard accounts of civil disobedience include nonviolence as a necessary condition. Here I argue that such accounts are mistaken and that civil disobedience can include violence in many aspects, primarily excepting violence directed at other persons. I base this argument on a novel understanding of civil disobedience: the special character of the practice comes from its combination of condemnation of a political practice with an expressed commitment to the political. The commitment to the political is a commitment to engaging with (...) others as co-members in the on-going political project of living together. I show how such an understanding of civil disobedience is superior to the Rawlsian strain of thought, which focuses on fidelity to law. Rawls was concerned with civil disobedience solely in the context of overriding political obligation. The project of characterizing a contestatory political practice that can be distinguished and used in a wider variety of contexts than Rawls is concerned with, including under illegitimate regimes, beyond the nation-state, or on behalf of anarchism, requires a different understanding of civil disobedience. Este artigo é um relato de experiência do processo de implantação do ambiente virtual de aprendizagem do Programa Primeira Infância Melhor (PIM). O PIM é uma política pública intersetorial de promoção do desenvolvimento integral na primeira infância, implantada no Estado do Rio Grande do Sul, Brasil. Entre as atribuições do Governo do Estado está a formação das equipes em mais de 200 municípios. Por causa das restrições impostas pela pandemia de coronavirus, a política deixou de realizar formações presenciais e, de (...) forma emergencial, promoveu formações remotas, utilizando a ferramenta Google Drive. A partir desta experiência, foi decidido implantar uma plataforma de formação online. Para tanto, foi realizado um longo processo de planejamento, com análise dos materiais existentes, adequação aos objetivos pretendidos, criação do ambiente virtual e realização de uma formação piloto na modalidade educação à distância. Bottom of the Pyramid organizations are the ones that develop a set of capabilities that contribute to create short- and long-term sustainability values inside and outside the boundaries of BoP ecosystems. Capabilities have an important role in BoP organizations’ strategies that aim to solve BoP issues. Notwithstanding its developments, BoP research still lacks theoretical contributions for the analysis of organizations. We suggest special attention to the need of advancing knowledge on capabilities of BoP organizations because this field is scattered and (...) fragmented, misinterpreted, and still underdeveloped in the literature. We oriented our research formulating and seeking answers to our main question on what are the capabilities needed to enable organizations to create sustainability values in BoP ecosystems? We conducted an integrative review of BoP research for the period from 1998 to 2019, and we found 22 key capabilities of BoP organizations. We organized the capabilities into four major categories including BoP Responsible Consumption, BoP Responsible Business Model, BoP Responsible Management, and BoP Responsible Innovation. We advanced propositions and discussions regarding the capabilities and major categories’ popularity, interdependence and combination, short- and long-term temporal functions, sustainability roles, and effectiveness to address BoP issues. Our article organizes the field of capabilities of BoP organizations; advances contributions and implications for management, organizations, and policymaking; and opens fruitful avenues for future research. I argue that legitimacy discourses serve a gatekeeping function. They give practitioners telic standards for riding herd on social practices, ensuring that minimally acceptable versions of the practice are implemented. Such a function is a necessary part of implementing formalized social practices, especially including law. This gatekeeping account shows that political philosophers have misunderstood legitimacy; it is not secondary to justice and only necessary because we cannot agree about justice. Instead, it is a necessary feature of actual human social practices, (...) which must be implemented via practitioners' discretion in changing contexts. (shrink)

The essays collected in this special issue explore what legitimacy means for actors and institutions that do not function like traditional states but nevertheless wield significant power in the global realm. They are connected by the idea that the specific purposes of non-state actors and the contexts in which they operate shape what it means for them to be legitimate and so shape the standards of justification that they have to meet. In this introduction, we develop this guiding methodology further (...) and show how the special issue’s individual contributions apply it to their cases. In the first section, we provide a sketch of our purpose-dependent theory of legitimacy beyond the state. We then highlight two features of the institutional context beyond the state that set it apart from the domestic case: problems of feasibility and the structure of international law. (shrink)

The development of neuropsychological assessment methods using virtual reality (VR) is a valid and promising option for the detection of cognitive impairment in the older people, focusing on activities composed of tasks of multiple demands. This study verified the association of age, schooling, and general cognitive status on the performance of neurologically healthy older adults in ECO-VR, a virtual reality task of multiple demands for neuropsychological assessment. A total of 111 older adults answered a sociodemographic questionnaire, the Mini Mental State (...) Examination, the Vocabulary subtest of the Wechsler Intelligence Scale for Adults (third edition), and the ECO-VR. Correlation analyses, multiple linear regression, and comparisons between groups (effects by age and schooling groups) were used to evaluate the results. The ECO-VR total score was significantly associated with age, years of education, MMSE, and Vocabulary subtest. The linear regression models identified that age was the main predictor for total score and rule breaking of ECO-VR. According to the univariate analysis, it was identified the main effect of age group and schooling group in the total ECO-VR score, but there was no interaction effect. The results are discussed in order to understand the role of sociodemographic characteristics in the performance of older adults in a virtual reality task of multiple demands. It was also verified the possibility use of virtual reality for neuropsychological assessment of older adults. (shrink)

I discuss the social dimension of musical experience. I focus on the question of whether there is joint musical listening. One reason for this focus is that Adorno and those in his tradition give us little in the way of an understanding of what the social dimension of musical experience might be. We need a proper clear conception of the issue, which the issue of joint experience yields. I defend a radically individualistic view, while conceding that such a view, inspired (...) by Hanslick, may have political ramifications. I have two arguments. The first is a principled argument against joint musical listening from the impossibility of perceiving the aesthetic properties of music. I connect this with the privacy of our grounds for aesthetic judgements about music. The second argument accepts that joint listening could in principle span different sense modalities, but draws attention to the fact that the experiences on which aesthetic judgements are based cannot be willed in a way they would have to be if there was joint listening. Lastly, I consider two phenomena, of making music together and dancing together, which seem to involve joint listening, but in fact do not. I end by drawing an individualist conclusion about the nature of musical experience. (shrink)

I argue for a new conception of practical authority based on an analysis of the relationship between authority and subject. Commands entail a demand for practical deference, which establishes a relationship of hierarchy and vulnerability that involves a variety of signals and commitments. In order for these signals and commitments to be justified, the subject must be under a preexisting duty, the authority’s commands must take precedence over the subject’s judgment regarding fulfillment of that duty, the authority must accept the (...) position and responsibilities of command, and the authority must be sufficiently trustworthy relative to how vulnerable the subject makes herself by deferring. This results in an instrumentalist conception of practical authority that can be favorably compared to Joseph Raz’s famous service conception. The relational conception’s main advantage is that it focuses on the authority as much as the subject, requiring that the authority accept responsibility for the relationship and be sufficiently trustworthy. Institutions undertake a huge variety of constitutive purposes. One of the roles of legitimacy is to protect and promote an institution’s pursuit of its purpose; state legitimacy is generally understood as the right to rule, for example. When considering legitimacy beyond the state, we have to take account of how differences in purposes change legitimacy. I focus in particular on how differences in purpose matter for the stringency of the standards that an institution must meet in order to be legitimate. (...) An important characteristic of an institution’s purpose is its deontic status, i.e. whether it is morally impermissible, merely permissible, or mandatory. Although this matters, it does so in some non-obvious ways; the mere fact of a morally impermissible purpose is not necessarily delegitimating, for example. I also consider the problem of conflicting, multiple, and contested institutional purposes, and the different theoretical roles for institutional purpose. Understanding how differences in purpose matter for an institution’s legitimacy is one part of the broader project of theorizing institutional legitimacy in the many contexts beyond the traditional context of the state. Background : researchers and sponsors increasingly confront the issue of whether participants in a clinical trial should have post-trial access (PTA) to the trial drug. Legislation and guidelines are inconsistent, ambiguous or silent about many aspects of PTA. Recent research highlights the potential importance of systematic reviews (SRs) of reason-based literatures in informing decision-making in medicine, medical research and health policy. Purpose: to systematically review reasons why drug trial participants should, or need not be ensured PTA to the trial drug (...) and the uses of such reasons. Data sources: databases in science/medicine, law and ethics, thesis databases, bibliographies, research ethics books and included publications’ notes/bibliographies. Publication selection: a publication was included if it included a reason as above. See article for detailed inclusion conditions. Data extraction and analysis: two reviewers extracted and analyzed data on publications and reasons. Results: of 2060 publications identified, 75 were included. These mentioned reasons based on morality, legality, interests/incentives, or practicality, comprising 36 broad (235 narrow) types of reason. None of the included publications, which included informal reviews and reports by official bodies, mentioned more than 22 broad (59 narrow) types. For many reasons, publications differed about the reason’s interpretation, implications and/or persuasiveness. Publications differed also regarding costs, feasibility and legality of PTA. Limitations: reason types could be applied differently. The quality of reasons was not measured. Conclusion: this review captured a greater variety of reasons and of their uses than any included publication. Decisions based on informal reviews or sub-sets of literature are likely to be biased. Research is needed on PTA ethics, costs, feasibility and legality and on assessing the quality of reason-based literature. (shrink)
